**General subscription conditions for services**


1. Object

The purpose of these general conditions is to define the terms and conditions of subscription for the multimedia assistance, maintenance and repair services offered by CyberPresta (hereinafter referred to as "the Service Provider").


2. Services offered

The Service Provider offers various subscription plans for computer and multimedia assistance, maintenance and repair services, including, but not limited to, face-to-face or remote technical assistance via software, preventive maintenance, troubleshooting by solving problems that the customer may encounter, repair by changing parts, hardware or software configuration through optimization, data recovery as far as possible, setting up a home network , installing or updating software, and training sessions or computer initiation.


3. Subscription and renewal

Subscription to the Service Provider's services is carried out online on the Service Provider's website or by any other means accepted by the Service Provider. Subscriptions are automatically renewable at the end of each subscription period, unless terminated by one of the parties under the conditions set out below.


4. Prices and terms of payment

The prices of the different subscription plans are indicated on the Provider's website and may be modified at any time. Payments are made monthly or annually, depending on the subscription plan chosen by the customer. Payments are made by credit card, bank transfer, direct debit or any other means accepted by the Service Provider.


5. Termination

The customer may terminate his subscription at any time by giving written notice to the Service Provider, only if the conditions defined in the subscription contract allow it. The Service Provider may terminate the subscription in the event of non-payment, violation of these general conditions or for any other legitimate reason, by giving written notice to the customer.


6. Liability

The Service Provider undertakes to provide the services diligently and competently, in accordance with the professional standards in force. However, the Service Provider's liability is limited to the total amount of the subscription fees paid by the customer during the twelve (12) months preceding the event giving rise to the complaint. The Service Provider cannot be held liable for indirect, consequential or special damages.


7. Confidentiality and data protection

The Service Provider undertakes to protect the client's personal and confidential data, in accordance with the applicable data protection and confidentiality laws.


8. Force majeure

The Service Provider cannot be held responsible for the non-execution or delay in the execution of its obligations in the event of force majeure, as defined by law, including, without limitation, natural disasters, fires, floods, strikes, riots, wars, terrorist acts, blackouts, network problems, or any other unforeseeable and irresistible circumstance beyond the control of the Service Provider.


9. Changes to the Terms and Conditions

The Service Provider reserves the right to modify these general conditions at any time. The modifications will come into effect as of their publication on the Service Provider's website or their written communication to the client. The continuation of the use of the services by the customer after the date of entry into force of the modifications will be worth acceptance of the new general conditions.


10. Applicable law and competent jurisdiction

These general conditions are governed by French law. Any dispute arising from the interpretation or execution of these general conditions will be subject to the exclusive jurisdiction of the courts of Haguenau, Strasbourg or a competent court.


11. Miscellaneous Provisions

If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, the other provisions will remain in full force and effect. The parties will endeavor to replace the invalid, illegal or unenforceable provision with a valid and enforceable provision having a similar economic effect.

**General Conditions of Sale for Dematerialized Products**


1. Object

These general conditions of sale (the "Conditions") govern the sale and supply of dematerialized products (the "Products") by CyberPresta (the "Seller") to its customers.


2. Order

The customer can place an order for the Products online via the Seller's website. All orders are subject to acceptance by the Seller. Once the order has been confirmed, the customer will receive a confirmation email with the order details and instructions for accessing the Products.


3. Price and Payment

The prices of the Products are indicated in euros and are subject to change without notice. Payment can be made online via payment methods accepted by the Seller. The customer is responsible for ensuring the validity of the payment information provided.


4. Delivery and Access

Digital Products will be accessible by download or via a download link provided by the Seller. The customer is responsible for verifying the compatibility of its equipment with the Products before purchase. The Seller cannot be held responsible for technical problems encountered by the customer when downloading or accessing the Products.


5. Right of Withdrawal

In accordance with the legislation in force, the customer acknowledges that the right of withdrawal may not apply to dematerialized Products once their download or access has been initiated.


6. Intellectual Property

The Seller retains all intellectual property rights to the Products sold. The customer is authorized to use the Products for personal and non-commercial purposes. Any reproduction, distribution or commercial use of the Products is strictly prohibited without the express authorization of the Seller.


7. Liability

The Seller strives to provide high quality Products. However, the Seller cannot guarantee that the Products will be free from errors or defects. Seller shall not be liable for any indirect, consequential or special damages related to the use of the Products.


8. Personal Data

The Seller collects and processes the customer's personal data in accordance with its privacy policy. The customer agrees that his data will be used for the purpose of processing the order and communication related to the Products.


9. Modification of the Conditions

The Seller reserves the right to modify these Conditions at any time. Changes will be posted on the Seller's website and will apply to orders placed after the date of the change.


10. Applicable Law and Jurisdiction

These Conditions are governed by French law. Any dispute relating to the sale of the Products will be subject to the exclusive jurisdiction of the courts of Haguenau, Strasbourg or a competent jurisdiction.

1. Object

These general conditions of sale (the "Conditions") govern the sale of material products (the "Products") by CyberPresta (the "Seller") to its customers.

The customer can order the Products online via the Seller's website, by telephone or in person. All orders are subject to acceptance by the Seller. Once the order has been confirmed, the customer will receive a confirmation email with the order details.


3. Price and Payment

The prices of the Products are indicated in euros and are subject to change without notice. Payment can be made online via payment methods accepted by the Seller. Payment must be made in full before delivery of the Products.


4. Delivery

The Seller undertakes to deliver the Products to the address indicated by the customer when ordering. Delivery times are given for information only and may vary depending on the availability of the Products and the delivery destination.


5. Transfer of Ownership

The ownership of the Products is transferred to the customer at the time of delivery and after receipt of full payment.


6. Warranty

The Seller guarantees that the Products are free from manufacturing defects and conform to the specifications. The duration and conditions of the warranty are indicated in the Product documentation.


7. Right of Withdrawal

In accordance with the legislation in force, the customer has a withdrawal period of 14 days from the delivery of the Products to exercise his right of withdrawal. The customer must inform the Seller of his decision to withdraw in writing.


8. Liability

The Seller cannot be held liable for damage resulting from improper use of the Products. Under no circumstances may the Seller's liability exceed the total amount paid by the customer for the Products.
